1. Introduction Welcome to Black Earth Blossoms (the "Farm," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website [yourdomain.com] (the "Site") and the purchase of our fresh-cut flower bouquets, arrangements, and related products ("Products").
By accessing the Site, placing an order, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase from us.
We are a small, local cut-flower farm in Lacombe County, Alberta, specializing in seasonal, fresh-cut flowers. All Products are perishable and made-to-order.
2. Orders and Acceptance
- All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including errors in pricing, product availability, or suspected fraud.
- Placing an order constitutes an offer to purchase. A contract forms only when we confirm your order (via email or in your account) and prepare/ship/pickup the Products.
- Due to the perishable nature of fresh flowers, orders cannot be cancelled, modified, or changed after confirmation. This includes changes to delivery address, pickup details, or bouquet customizations once harvesting/preparation begins.
3. Pricing and Payment
- Prices are in Canadian dollars (CAD) and include GST where applicable. Delivery/pickup fees are separate and shown at checkout.
- We accept payments via [list your methods: Shopify Payments, credit cards, etc.]. Full payment is required at checkout.
- You are responsible for any additional taxes, duties, or fees not included in the price.

4. Delivery, Pickup, and Risk of Loss
- Local Delivery (our own service): We deliver to specified Central Alberta zones on scheduled days/times. Risk of loss, damage, or deterioration passes to you upon handover at the provided address (or safe drop-off if pre-arranged). Inspect immediately and report issues per our Returns and Refunds Policy (within 24 hours). We are not liable for issues after handover, including wilting due to care, weather, or delays in acceptance. Missed deliveries due to incorrect info or access issues may incur redelivery fees or be considered fulfilled.
- Local Pickup: Orders must be collected during the stated window. Authorized alternates allowed with 24-hour notice (see Returns and Refunds Policy). Unclaimed orders are forfeited and donated—no refunds.
- We harvest and prepare Products at peak freshness. Delays beyond our control (e.g., weather, traffic) do not entitle you to refunds.
5. Product Information and Disclaimers
- Fresh-cut flowers are natural, perishable products. Vase life varies (typically 5–10 days with proper care). We provide care instructions, but results depend on your handling, water quality, environment, etc.
- Colours, varieties, and sizes may vary slightly due to seasonal availability and natural growth. Photos are representative.
- Products are sold "as is." We disclaim all warranties, express or implied, including merchantability or fitness for a particular purpose, to the fullest extent permitted by law—except as required under Alberta's Sale of Goods Act for merchantable quality at time of handover.
6. Limitation of Liability To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, data, or goodwill) arising from your use of the Site, Products, or these Terms—even if advised of the possibility.
- Our total liability is limited to the amount you paid for the specific Product(s) in question.
- Nothing limits liability for gross negligence, wilful misconduct, or as required by applicable law.
7. Indemnification You agree to indemnify and hold us harmless from claims, losses, or damages arising from your breach of these Terms, misuse of Products, or violation of law.
8. Intellectual Property The Site, photos, descriptions, and content are our property or licensed to us. You may not copy, reproduce, or use them without permission except for personal, non-commercial use.
9. Governing Law and Dispute Resolution These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes shall be resolved exclusively in the courts of Edmonton, Alberta.
10. Changes to Terms We may update these Terms at any time. Changes are effective when posted. Continued use constitutes acceptance.
